Nova Citizen is not an emergency service. In an emergency — fire, crime in progress, medical crisis, or any threat to life or property — call 911 or your local emergency hotline immediately. Do not rely on Nova Citizen to summon help. Alerts and reports in the app may be delayed, incomplete, or unavailable, and we cannot guarantee any government office or responder will see or act on a report you submit.
These Terms of Service ("Terms") are an agreement between you and Nova Citizen ("we," "us," "Nova Citizen," or the "App") and govern your use of our mobile application, website at novacitizen.tech, and related services (together, the "Services"). Please read them carefully. By creating an account, submitting a report, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services. You agree that accepting these Terms electronically — by using the Services — is valid and binding under the Philippine Electronic Commerce Act of 2000 (Republic Act No. 8792).
1. Who We Are
The Services are operated by Zentarai Labs, the operating name of LFGTTM LLC, a limited liability company organized in the State of Florida, USA, serving users in the Philippines from Makati City, Metro Manila. For how we handle your data, see our Privacy Policy, which is incorporated into these Terms and explains your rights under the Philippine Data Privacy Act of 2012 (Republic Act No. 10173).
2. Eligibility
You must be at least 13 years old to use the Services. If you are between 13 and 18, you should review these Terms with a parent or guardian and use the Services with their consent. By using the Services, you represent that you meet these requirements and that the information you provide is accurate.
3. What Nova Citizen Is — and Is Not
Nova Citizen is a free public-safety platform that lets residents view real-time incident alerts and official advisories, submit and view community safety reports, explore a safety map, read local guides, and use related civic features.
- It is informational and community-driven. Much of the content comes from other users or from public sources. We do not independently verify reports, and we do not guarantee that any alert, report, advisory, guide, or map is accurate, complete, current, or suitable for any purpose.
- It is not an emergency, government, or professional service. Nova Citizen is not operated by, and does not represent, any government agency or emergency responder, and is not a substitute for official channels or professional (legal, medical, or safety) advice.
- Reports are best-effort. Submitting a report through the App does not guarantee that any barangay, LGU, agency, or responder will receive it, prioritize it, or act on it.
4. Your Account
Some features require an account. You may be able to register directly or sign in through Google or Apple. You agree to:
- Provide accurate information and keep it up to date;
- Keep your login credentials secure and not share your account;
- Be responsible for activity that happens under your account; and
- Notify us promptly at [email protected] if you suspect unauthorized use.
You may use parts of the web experience without an account; the rest of these Terms still apply.
5. Acceptable Use
To keep the community safe and trustworthy, you agree not to:
- Submit false, misleading, fabricated, or deliberately exaggerated reports or alerts;
- Harass, threaten, defame, dox, or invade the privacy of any person;
- Post content that is unlawful, hateful, obscene, or that incites violence;
- Impersonate any person, official, or organization, or misrepresent your affiliation;
- Upload content you do not have the right to share, or that infringes anyone's intellectual-property or privacy rights;
- Use the Services to violate any applicable Philippine law (including the Data Privacy Act, RA 10173, and the Cybercrime Prevention Act, RA 10175);
- Interfere with, overload, scrape at scale, reverse-engineer, or attempt to gain unauthorized access to the Services or their security features; or
- Use the Services to spam, advertise, or for any commercial purpose without our written consent.
Misusing a safety platform — for example, filing false emergency-type reports — can endanger real people and may carry legal consequences.
6. Your Content
"Your Content" means anything you submit through the Services — reports, descriptions, photos, videos, comments, reactions, and profile details.
- You keep ownership. You retain the rights you have in Your Content.
- You give us a license to run the Services. You grant Nova Citizen a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt (for formatting), and distribute Your Content to operate, promote, and improve the Services — for example, showing your report and its location to other users in the feed, on the map, and in real-time alerts. This license ends when Your Content is deleted from our active systems, except for backups retained for a limited time and for content others have already shared or that we must keep to comply with law.
- You are responsible for it. You represent that you have the rights to submit Your Content and that it does not violate these Terms or anyone's rights. Do not submit content you would not want made public.
- Feedback. If you send us suggestions, we may use them without obligation to you.
7. Moderation and Enforcement
We want the platform to stay useful and safe, so we may — but are not obligated to — review, moderate, remove, or restrict any content, and we may warn, suspend, or terminate any account, with or without notice, if we reasonably believe these Terms have been violated or that doing so is necessary to protect users, the public, or the Services. Where practical, we will try to act fairly and proportionately. Trust scores and similar signals described in our Privacy Policy may inform these decisions.
8. Third-Party Content and Links
The Services display content from third parties — for example, news articles from Philippine outlets and advisories from agencies such as NDRRMC, PAGASA, PNP, DOH, and MMDA — and may link to third-party sites. We do not control, endorse, or guarantee this content, and we are not responsible for it. Your use of any third-party service is governed by that third party's terms.
9. Intellectual Property
The Services themselves — including the software, design, "Nova" and "Nova Citizen" branding, text, and graphics we provide (excluding Your Content and third-party content) — are owned by Zentarai Labs or its licensors and are protected by Philippine and international law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. All rights not expressly granted are reserved.
10. Fees
The Services are free for citizens. There are no ads, and we do not sell your personal information (see the Privacy Policy). If we ever introduce a paid feature, we will make that clear before you are charged.
11. Disclaimers
To the fullest extent permitted by law, the Services and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that alerts, reports, or advisories will be timely, accurate, or complete.
Safety reminder. Never delay calling 911 or following official instructions because of something you did or did not see in Nova Citizen. The App supplements — it never replaces — official emergency and government channels.
12. Limitation of Liability
To the fullest extent permitted by law, Nova Citizen and Zentarai Labs (and our officers, employees, and partners) will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, goodwill, or profits, arising out of or relating to your use of (or inability to use) the Services, your reliance on any content, or the conduct of other users — even if we have been advised of the possibility of such damages.
Where liability cannot be excluded under applicable law, our total liability to you for all claims relating to the Services will not exceed one hundred US dollars (US$100) or its peso equivalent. Some jurisdictions do not allow certain limitations, so some of these may not apply to you; in that case, our liability is limited to the smallest extent permitted by law. Nothing in these Terms limits liability that cannot lawfully be limited.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Nova Citizen and Zentarai Labs from claims, damages, and reasonable expenses arising from Your Content, your misuse of the Services, or your violation of these Terms or of applicable law or the rights of others.
14. Suspension and Termination
You may stop using the Services and delete your account at any time. We may suspend or end your access as described in Section 7, or if we discontinue the Services. Provisions that by their nature should survive — including Sections 6 (license to content already shared), 9, 11, 12, 13, and 16 — will survive termination.
15. Changes to These Terms
We may update these Terms as the Services evolve or as the law changes. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in-app or by email before the changes take effect. Continuing to use the Services after the changes take effect means you accept the updated Terms. If you do not agree, please stop using the Services.
16. Governing Law and Consumer Rights
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws rules. Nothing in these Terms waives or limits any right you have that cannot be waived under Philippine law — including your rights under the Consumer Act of the Philippines (Republic Act No. 7394) and the Data Privacy Act of 2012 (Republic Act No. 10173).
You and we agree to try in good faith to resolve any dispute informally first by contacting [email protected]. Disputes that cannot be resolved informally will be brought before the proper courts of the Philippines; nothing here prevents you from bringing a claim before the courts or consumer authorities that have jurisdiction over your place of residence where the law gives you that right. Complaints about how we handle your personal data may also be filed with the National Privacy Commission (privacy.gov.ph), as described in our Privacy Policy.
